Nurse claims Eagleville Hospital terminated her because of her age

PHILADELPHIA – A registered nurse is suing her employer following her termination, alleging that she was fired because of her age.

Jane Kleba filed a complaint on Dec. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Eagleville Hospital, citing violations of the Age Discrimination in Employment Act and the Pennsylvania Human Relations Act.

According to the complaint, Kleba, 70, was hired as a nurse more than nine years before her termination. During her employment, she worked under the management of an individual who allegedly was known to be biased against individuals who were older. One day in 2013, prior to her termination, Kleba allegedly was confronted about a bag of mislabeled pills, and was accused of being the one who was at fault for the incident. Even though there were other nurses who had access to the bag and even though Kleba denied having a hand in the incident, she was terminated from her position, the complaint states.

Kleba is seeking compensation of an unspecified amount for all damages. She is represented by M. Susan Toth of Console Law Offices LLC in Philadelphia.
