Man sues debt collection agency alleging harassment and violation of privacy rights

SCRANTON – A Carlisle man is suing a debt collection agency claiming violation of the Fair Debt Collection Practices Act after he was harassed about a debt which was not his.

Phillip Bergstresser filed a complaint in the U.S. District Court for the Middle District of Pennsylvania against Cedar Financial alleging violation of the FDCPA.

Bergstresser began to receive calls from Cedar Financial in January in regards to collected a debt for a parking violation in Italy, the complaint states. The plaintiff alleges that the defendant failed to provide documentation of the debt which was to be collected, and Bergstresser denied any knowledge of said debts. Despite this information, however, the agency continued to call Bergstresser, causing him anxiety due to the harassment, according to the complaint.

Bergstresser is seeking compensation for all wrongs committed, as well as all legal fees incurred. He is represented by Craig Thor Kimmel of Kimmel and Silverman PC in Ambler.
