PITTSBURGH – A Michigan customer is suing GNC for negligent misrepresentation after certain products were allegedly found to contain illegal prescription substances.
Jeff Johnston filed a complaint on Dec. 1 in the U.S. District Court for the Western District of Pennsylvania against GNC alleging negligent misrepresentation, design defect, unjust enrichment and violation of the Michigan Consumer Protection Act.
According to the complaint, Johnston, a customer of GNC, purchased Redline Ultra Hardcore. Allegedly unknown to Johnston, the product contained chemical substances, known as Picamilon and BMPEA, which are illegal substances in the U.S. Designed and outlawed in the past, these substances should never have been made to be ingredients in GNC's products, and the company should have known and informed customers of their inclusion, the suit states. Johnston is suing the corporation for alleged negligence in failing to inform customers of the ingredients.
Johnston is seeking compensation for damages suffered and legal fees incurred. He is represented by Jonathan Shub of Kohn, Swift and Graf PC in Philadelphia.
