Woman sues Community Recycling over allegations of wrongful termination

PHILADELPHIA – A woman is suing her former employer after she claims she was terminated because of her disability.

Lisa A. Pomerantz filed a complaint on Dec. 15 in the U.S. District Court for the Eastern District of Pennsylvania against Ares Holdings LLC, Community Recycling and ESB Trading Co. LLC and its president/owner, Ira Baseman, alleging violation of the Americans with Disabilities Act, the Pennsylvania Human Relations Act, the Pennsylvania Wage Payment and Collection Law and unfair termination.

According to the complaint, Pomerantz was employed by the defendant in September 201, and held the position of the vice president of marketing and business development. Pomerantz suffers from chronic neck pain and uses a bionic device to help her manage the pain. In May 2013, the device stopped working, causing the plaintiff great pain. Pomerantz had to undergo surgery to replace the device in October 2013. She took six days off for the surgery and continued to work from home beginning Oct. 14, 2013, sending updates on her workload. She was cleared to return to work that December and claims that when she did, Baseman allegedly was hostile toward her. She allegedly was terminated in January 2014.

Pomerantz is seeking compensation for all damages suffered and for her legal fees. She is represented by Scott M. Pollins of the Pollins Law Firm in Swarthmore.
