Apple American Group sues Ohio contractor over allegations of negligence

PITTSBURGH – Apple American Group, owners of the Applebee's Neighborhood Grill and Bar franchises, is suing an Ohio contractor after the defendant purportedly was negligent in the completion of a project.

Apple American Group LLC filed a complaint Dec. 14 in the U.S. District Court for the Western District of Pennsylvania against GBC Design Inc., alleging negligence, unjust enrichment and breach of contract.

According to the complaint, the plaintiff entered into a contract with GBC in March 2013, which included the agreement to complete a grading, drainage and erosion plan for an Ebensburg restaurant location, designed to prevent damages to the property. In 2014, the project was declared complete, however, before the following October, the complaint states that the job allegedly had not been completed satisfactorily, as water was not draining, sidewalks and driveways were cracking and buckling and roofs, windows and doors were unable to handle draining. The restaurant was forced to close in order to repair the problems, according to the complaint.

Apple American is seeking compensation for fees, court costs and any other relief the court deems appropriate. It is represented by Alexander W. Saksen of Gordon & Rees LLP in Pittsburgh.
