PHILADELPHIA – A Philadelphia woman is suing an insurance company for coverage for injuries she allegedly sustained in a vehicle-pedestrian accident.
Solaris Power filed a lawsuit Jan. 11 in U.S. District Court for the Eastern District of Pennsylvania against State Farm Mutual Automobile Insurance Co., alleging breach of contract and bad faith.
At approximately 4 p.m. on Jan. 18, 2013, the suit states, Power was in an accident when she allegedly legally attempted to cross the intersection of 12th and Walnut streets in Philadelphia and a man driving southbound on 12th Street struck her.
The incident caused Power serious personal injuries, and she settled in court for $14,000 in July, the complaint states.
However, the suit states the value of her injuries is substantially more than the value of the settlement, so Power made a claim under her underinsured motor vehicle coverage with State Farm. On Aug. 19, State Farm allegedly denied Power's claim and continues to deny it, which Powers claims is a breach of contract.
Power seeks a judgment of more than $75,000, plus interests and costs. She is represented by attorneys Joan E. Clarke and Joe H. Tucker Jr. of Tucker Law Group in Philadelphia.
