PHILADELPHIA — A Horsham man is suing an auto repair business, alleging he was denied overtime pay and bonuses.
David Hoover, individually and on behalf of all others similarly situated, filed a lawsuit Jan. 7 in the U.S. District Court for the Eastern District of Pennsylvania against Mid-Atlantic Lubes Inc , trading as Jiffy Lube in Warminster, and Mark I. Rhee, alleging violation of Fair Labor Standards Act.
According to the complaint, Hoover worked as a customer service technician and assistant manager during his time at Mid-Atlantic between November 2011 and October 2012, and February 2013 to March 2015, and was legally owed overtime pay for hours worked more than 40 a week.
The suit says the plaintiffs were promised a certain pay rate and bonuses, however, the defendant failed to deliver such payments. The suit also states that defendant eliminated or altered the time entries of the plaintiffs to avoid the pay rate.
Hoover seeks damages for all lost wages and benefits, as well as legal fees. He is represented by attorneys Eric B. Meyer and Jerry R. DeSiderato of Dilworth Paxson LLP in Philadelphia, and attorneys Steven K. Eisenberg and Evan Barenbaum of Stern & Eisenberg PC in Warrington.
