Palmerton couple sues Family Dollar Stores Inc. alleging negligence

SCRANTON – A Palmerton couple is seeking damages following an incident in the Palmerton Family Dollar store.

Lori Kershner and Chad Kershner filed a complaint on Jan. 19 in the U.S. District Court for the Middle District of Pennsylvania against Family Dollar Stores Inc., alleging negligence.

According to the claim, on April 22, 2014, Lori Kershner was reaching for a box on a shelf at the defendant's premises when she stepped backward and her foot caught on a box, which caused her to fall and suffer injuries. At the time of the incident, Lori Kershner was in the store as a business invitee, the suit states, and it was the responsibility of the defendant to maintain the store in a safe condition for guests. Kershner alleges she suffered injuries to her shoulder and ankle, as well as a concussion.

The Kershners seek damages of more than $75,000, as well as legal fees. They are represented by Gerald F. Strubinger Jr. of Strubinger Law PC in Palmerton.
