PHILADELPHIA – A Washington, D.C. man is seeking damages following an Amtrak accident in which he claims was caused by negligence.
Joshua Gotbaum filed a complaint on Jan. 21 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., also known as Amtrak, alleging negligence.
According to the claim, the plaintiff was a passenger on train 188 on May 12 when the incident took place. The suit states that the train was traveling from Washington, D.C., to New York and approached a curve near Philadelphia. Despite posted warnings on the tracks and technology to prevent incidents, the suit says that the operator failed to heed the warnings and instead maintained speeds of more than two times the limit. As a result, the plaintiff was thrown from his seat and lost his glasses, the suit says, and he also suffered multiple other injuries including broken ribs, knee injury requiring replacement and emotional and mental anguish.
