Former employee claims Kaytee Products terminated him because of his cataracts

SCRANTON – A Pottsville man is seeking damages following his allegedly wrongful termination, claiming that it was due to the fact that he had cataracts.

Paul Filiac, 64, filed a complaint Jan. 20 in the U.S. District Court for the Middle District of Pennsylvania against Kaytee Products Inc., alleging violation of the Americans with Disabilities Act, the Age Discrimination in Employmet Act and the Pennsylvania Human Relations Act.

According to the claim, Filiac was employed from 1999 until 2014 and maintained satisfactory job performance ratings. The plaintiff suffered from cataracts, which falls under the ADA, and in May 2014, following a positive performance review, the suit says, he was terminated. The defendant claimed that the reason was lack of work, the suit says, however, the plaintiff alleges that it was because of his age and cataracts, as he believes he was replaced by a younger and less-qualified employee.

Filiac seeks damages for lost wages, mental anguish, loss of enjoyment of life, as well as case costs. He is represented by Sidney L. Gold of Sidney L. Gold & Associates PC in Philadelphia.
