Man seeks damages, alleging that he was terminated because of his age

PHILADELPHIA – A North Carolina man is seeking damages following his termination, claiming that it was caused by the defendant's discrimination due to his age.

David Boersema filed a complaint Jan. 21 in the U.S. District Court for the Eastern District of Pennsylvania against Stonemor Partners LP, alleging violation of the Age Discrimination in Employment Act and Pennsylvania Human Relations Act.

According to the claim, the plaintiff was employed by the defendant from 2000 until 2015, during which time he was promoted to regional vice president of sales because of his high sale numbers. Although the suit states that he received positive performance ratings, he was allegedly discriminated against due to his age. The suit states that the plaintiff was terminated on Feb. 12, 2015, for performance issues and was replaced by a younger employee. The plaintiff alleges he was terminated because of his age.

Boersema seeks damages of more than $2,220,000 for lost wages, punitive damages of more than $200,000, legal fees of more than $30,000 and court costs. He is represented by Christopher DelGaizo and Christi Wallace of Kraemer, Manes & Associates LLC in Pittsburgh.
