Worker alleges Arborlea, Keystone Tree violated ADA

PHILADELPHIA — A Quakertown worker is suing a tree business, alleging violation of the ADA .

Dennis Cleary filed a complaint on Jan. 27 in the U.S. District Court for the Eastern District of Pennsylvania against Arborlea Corporation and Keystone Tree Expert Co, both of Doyelstown, alleging violation of the ADA.

According to the complaint, Cleary was employed by the defendant for 23 years as a dedicated employee. The suit says the plaintiff began to suffer from knee and thyroid problems, acute renal failure and viral infection of his heart near the end of his employment, which affected his daily activities.

In December 2014, Cleary says he informed his managers of an upcoming surgery, and of his return to work in May 2015. He also sought worker's compensation.

Following his surgery, the lawsuit states, Cleary required another surgery and informed his managers. On March 25, 2015, Cleary was informed of his termination, even though he was on track to return in May, the suit says.

Cleary seeks compensation for lost pay and benefits, reinstatement, relief for emotional distress and legal fees. He is represented by attorney Ari R. Karpf of Karpf, Karpf & Cerutti PC in Bensalem.
