PHILADELPHIA – A Philadelphia man is seeking damages following his termination, claiming age discrimination and retaliation.
Dr. Theodore Magida filed a complaint on Feb. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Temple University, Temple University School of Medicine, Temple University Radiology Department and Dr. Charles A. Jungreis, citing violation of the Age Discrimination in Employment Act and the Pennsylvania Human Relations Act.
According to the claim, the plaintiff was employed by the defendant as a radiologist in 2009, with a yearly pay of $325,000. The suit states that he was a satisfactory employee. Beginning in 2011 through 2013, the suit states that Jungreis, Magida's boss, asked if he was planning on retiring, even encouraging Magida to retire due to his age, which offended the plaintiff. The suit states that Jungreis threatened termination, offering extended health benefits if Magida retired. On Aug. 19, 2013, Jungreis terminated the plaintiff, the suit states, and afterward hired three younger radiologists. The suit states he was 62 at the time of his termination.
Magida seeks reinstatement, damages for wrongful termination, age discrimination, lost salary, benefits, humiliation, emotional distress, anxiety, fear and legal fees. He is demanding a jury and is represented by Brian R. Mildenberg of the Mildenberg Law Firm PC in Philadelphia.
