Employee accuses Apria Healthcare of ADA violations

PITTSBURGH — A former employee is suing a Canonsburg company, alleging her termination violated the Americans with Disabilities Act.  

Danielle Davis filed a lawsuit July 21 in U.S. District Court for the Western District of Pennsylvania against Apria Healthcare Inc. of Canonsburg, alleging violation of the ADA.

According to the complaint, Davis was employed by Apria as a medicare collections representative. The suit says she suffered from systemic lupus erythematosus and Stage IV endometriosis, which caused problems with her immune system.

Due to the complications of her condition, the lawsuit states, the plaintiff requested four weeks of unpaid medical leave Sept. 12-Oct. 28, 2014, so she could undergo surgery.

Following her providing medical information, Davis requested remote work but, on Oct. 8, 2014, the request was denied. Instead of offering an alternative, the complaint says, the plaintiff was terminated, effective Oct. 28, 2014. 

Davis seeks damages of lost wages and back pay, reinstatement, compensatory and punitive damages, attorney fees and other expenses. She is represented by attorney Charles A Lamberton of Lamberton Law Firm LLC in Pittsburgh.
