Disabled man alleges Warp Processing prohibited him from work due to disability

PITTSBURGH — A Harding man is suing an Exeter company, alleging he was deprived wages and employment opportunities due to his disabilities.

Donald J. Ramage filed a lawsuit Feb. 12 in the U.S. District Court for the Middle District of Pennsylvania against Warp Processing Inc. of Exeter, alleging discrimination due to his disabilities.

The suit states in 2004 Ramage was diagnosed with Meniere's disease, which did not affect his ability to work but on Nov. 21, 2014, he was checked out by a company doctor and later demoted because of his disability.

According to the complaint, on Dec. 16, 2014, Daniel Dugan, Ramage's manager, told him he was placed on medical layoff, but on Dec. 31 and again in February 2015, his doctor cleared the plaintiff for work. On Jan. 12,  2015, the lawsuit states, Ramage was asked for more medical documentation, which was in violation of EEOC. The suit states the defendant continued to prohibit the plaintiff from working.

The plaintiff alleges emotional distress.

Ramage seeks damages for retaliation, back pay, punitive damages, attorney fees and costs, plus a a jury trial. He is represented by attorney Cynthia L. Pollick in Pittston.
