PHILADELPHIA — A company is suing a former co-owner, citing alleged violation of obligation and breach of duty of loyalty.
On Time Lighting LLC filed a complaint on April 21 in the U.S. District Court for the Eastern District of Pennsylvania against Shawn S. Varghaizadeh. alleging that the former co-owner and then employee of the company violated the terms of an agreement.
The plaintiff says that while the defendant was still associated with On Time Lighting, he had an ownership interest with AcuFab LLC, engaged in business which competes directly with plaintiff's lighting business and violated his contractual obligation to devote his full time and attention exclusive to the terms of his employment agreement.
The plaintiff requests a trial by jury and seeks a permanent injunction enjoining and restraining defendant from violating their agreement, compensation for damages in excess of $75,000, punitive damages, pre-judgment and post-judgment interest and for such other relief that the court may deem just and proper.
