Former employee of hospital alleges age discrimination

PHILADELPHIA — A woman is suing Mercy Philadelphia Hospital and Mercy Health System, her former employer, citing alleged age discrimination, disability discrimination, and wrongful termination.

Arlene Davis Roberts filed a complaint on April 21 in the U.S. District Court for the Eastern District of Pennsylvania against Mercy Philadelphia Hospital and Mercy Health System, alleging that her former employer violated the Age Discrimination in Employment Act.

According to the complaint, the plaintiff alleges that on or about Oct. 15, 2013, she was diagnosed with breast cancer and was required to undergo several months of chemotherapy, surgery and radiation therapy. On or about Feb 13, 2014, she was granted supplemental leave of absence and a return date of July 20, 2014, the suit says. When she attempted to return to work on October 22, 2014, she was verbally informed that she was terminated, according to the complaint.

The plaintiff holds Mercy Philadelphia Hospital and Mercy Health System responsible because the defendant allegedly terminated her due to her age, disability/perceived disability and in retaliation for invoking her rights, failed to provide reasonable accommodation and failed to rehire her for the open position she applied.

The plaintiff requests a trial by jury and seeks compensation for lost wages and benefits, pecuniary losses, pain, suffering, mental anguish and loss of employment, attorneys' fees and costs, pre-judgement and post judgement interest.
