University health system accused of violating wage laws

PHILADELPHIA — Employees have filed a class-action lawsuit against The University of Pennsylvania Health System, a research and clinical care organization, citing alleged violation of wage laws.

Crystal Holley, Adrianne Corbin, April Smalls and Adam Norris filed a complaint on behalf of similarly situated employees on April 1 in the U.S. District Court for the Eastern District of Pennsylvania against The University of Pennsylvania Health System, alleging that the research and clinical care organization failed to pay plaintiffs properly for overtime hours in connection with hours worked during holidays.

According to the complaint, the plaintiffs allege that, in May 2013, Crystal Holley, Adrianne Corbin, April Smalls and Adam Norris received an email that hours worked on holidays would no longer be counted toward calculating overtime in pay periods. The plaintiffs hold The University of Pennsylvania Health System responsible because the defendant allegedly amended the policy, exerted pressure on the plaintiffs and even threatened them with discipline, which caused fear among the employees.

The plaintiffs request a trial by jury and seek compensation, reimbursement of lost earnings and unpaid overtime, liquidated damages, costs and expenses, and reasonable legal fees. They are represented by Ari R. Karpf of Karpf, Karpf & Cerutti P.C. in Bensalem.
