Sellersville resident accuses company of telephone harassment

PHILADELPHIA — A consumer is suing Navient Solutions Inc. and Does 1-10, Arizona corporation, citing alleged violation of telephone harassment statutes.

Robert Bersler filed a complaint on April 11 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that within the last four years, defendants started calling him in an attempt to reach a person he does not know. He has never provided them his contact number nor has given them express permission to call him. The plaintiff holds Navient Solutions, Inc. and Does 1-10 responsible because the defendants allegedly placed calls using an automatic telephone dialing system and/or by using prerecorded messages and continued to make calls after being advised multiple times to ceased calling him.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory damages of $500 for each violation and $1,500 for each willful and/or knowing violations and for such other relief as may be just and proper.
