PHILADELPHIA — A pet gear supply company is suing Factory Direct Wholesale LLC, a wholesaler, citing alleged trademark infringement.
Vermont Juvenile Furniture Manufacturing Inc., doing business as Pet Gear Inc. filed a complaint on April 14 in the U.S. District Court for the Eastern District of Pennsylvania against Factory Direct Wholesale LLC alleging that the wholesaler violated the United States Patent Law.
According to the complaint, the plaintiff alleges that in or around September 2011, it discovered that defendant was selling pet booster seats that infringed its patents. This infringing activity has caused and will continue to cause the plaintiff irreparable harm, damage and injury unless defendant is restrained and enjoined by the court, the suit says. The plaintiff holds Factory Direct Wholesale LLC responsible because the defendant allegedly wrongfully infringed on its patents despite promises to stop doing so.
The plaintiff requests a trial by jury and seeks declaration that defendant has infringed on two patents, an order to remove or disable all websites selling infringing booster seats, an award for all damages, pre-judgement and post-judgement interest, attorneys' fees incurred for this action and for all other relief that the court may deem just and proper.
