PITTSBURGH — A former emoloyee has filed a class-action lawsuit against TMK IPSCO Koppel Tubulars LLC, citing alleged unpaid wages and benefits and unlawful termination.
William Brikhimer filed a complaint on behalf of all others similarly situated on April 15, in the U.S. District Court for the Western District of Pennsylvania against TMK IPSCO Koppel Tubulars LLC, alleging that the former employer violated the Worker Adjustment and Retraining Notification Act.
According to the complaint, the plaintiff alleges that, on Feb. 5, he was terminated without cause together with approximately 200 other employees. As a result, he suffered damages due to lost wages, benefits and other monies, the suit says. The plaintiff holds TMK IPSCO Koppel Tubulars LLC responsible because the defendant allegedly failed to provide at least 60 days' advance written notice of termination as required by the WARN Act, failed to pay their respective wages, salary, commissions, bonuses, accrued holiday pay and accrued vacation and failed to make 401(k) contributions and provide them with health insurance coverage and other employee benefits.
The plaintiff requests a trial by jury and seeks compensation for unpaid wages, salary, commissions and bonuses plus interest, attorneys’ fees, costs and disbursements and such other and further relief as the court may deem just and proper.
