Woman claims wrongful termination by health care agency

PHILADELPHIA — A health aide is suing A.H. Home Health Care Service LLC, a former employer, alleging wrongful termination and failure to provide accommodation.

Amanda Johns filed a complaint on April 19 in the U.S. District Court for the Eastern District of Pennsylvania against A.H. Home Health Care Service LLC, alleging that the former employer violated the Pregnancy Discrimination Act.

According to the complaint, the plaintiff alleges that she had a high-risk pregnancy and needed to take intermittent days off from work. Upon learning of her condition, defendant's management started treating her in a rude and demeaning manner, excluded her and spoken to abruptly, the suit says. In May 2015, the plaintiff says, she informed defendant's management that she might not be able to work with a client she was assigned to because of her high-risk pregnancy. The following day, management informed her that she no longer had a position within the company and that she needed to submit her resignation letter, the suit alleges. The plaintiff holds A.H. Home Health Care Service LLC responsible because the defendant allegedly failed to accommodate her and instead terminated her.

The plaintiff requests a trial by jury and seeks judgment prohibiting the defendant from continuing its illegal policy, compensating her for all pay and benefits due to her, liquidated and punitive damages, costs and expenses and any other relief as the court deems just and proper.
