Kitchen cabinet supplier accuses competitor of trademark infringement

HARRISBURG — A kitchen cabinet supplier is suing Joseph D. Derogatis and floW Home Products, a competitor, citing alleged trademark infringement, breach of contract and unfair competition.

The Wolf Organization LLC filed a complaint on April 26, in the U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that they allegedly violated the United States Patent and Trademark Office.

According to the complaint, the plaintiff alleges that it has suffered and will continue to suffer irreparable harm and damage to reputation unless the court has rendered a decision enjoining defendants from further infringing WOLF Marks. The plaintiff holds Joseph D. Derogatis and floW Home Products responsible because the defendants allegedly breached their settlement agreement and intentionally copied the copyrighted WOLF Marks, used it on their social media pages in connection with the same type of product, PVC decking and intentionally used the typeface "floW" because it is "Wolf" spelled backwards.

The plaintiff requests a trial by jury and seeks declaration defendants have infringed its rights and has engaged in unfair competition, an order directing defendants to remove the infringing marks from any website or web account or social media platforms, compensation for all damages, attorneys' fees and costs and any other relief that the court may deem proper. It is represented by Donald B. Kaufman and Sarah Hyser-Staub of McNees Wallace & Nurick LLC in Harrisburg.
