PITTSBURGH – A training specialist has filed a class-action lawsuit against his former employers over allegations he was not paid overtime wages.
John Bowser filed a complaint on behalf of others similarly situated on April 21 in the U.S. District Court for the Western District of Pennsylvania, Pittsburgh Division against Duke Energy, The Empyrean Group LLC and Guidant Group Inc. alleging that they allegedly violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he typically worked 50 hours per week and was only paid straight time for all hours worked. The plaintiff holds Duke Energy, The Empyrean Group LLC and Guidant Group Inc. responsible because the defendants allegedly failed to pay him at one-and one-half times his regular hourly rate for all hours worked in excess of 40 in a workweek and failed to correct their payroll policy.
The plaintiff requests a trial by jury and seeks compensation for all unpaid overtime wages, liquidated damages, attorneys’ fees, costs, and expenses, prejudgment and post-judgment interest and all such other and further relief to which he is entitled.
