PHILADELPHIA — An outside sales representative is suing Vantage Learning LLC, Vantage Learning (USA) LLC, McCann Associates, Inc. Brian Gibney and Peter Murphy, citing alleged disability discrimination, retaliation, and violation of the Family and Medical Leave Act.
Matthew Zinman filed a complaint on May 2 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they allegedly retaliated against him for opposing discriminatory treatment premised upon his FMLA usage.
According to the complaint, the plaintiff alleges that he had not receive any discipline prior to January 2016 or until after he disclosed health issues and requested accommodations. He allegedly has a long history of suffering from bipolar disorder, anxiety and other related conditions. He allegedly encountered extreme retaliation, discrimination and interference with his anti-discrimination rights. The plaintiff holds Vantage Learning LLC, Vantage Learning (USA) LLC, McCann Associates, Inc. Brian Gibney and Peter Murphy responsible because the defendants allegedly deprived him of any interactive process to discuss his health condition, placed him on an involuntary 90-day medical leave, and prohibited him from intermittently taking days off either for medical treatment or for his health condition.
The plaintiff requests a trial by jury and seeks compensation for all damages, legal fees, costs and expenses and any and all other equitable relief as the court deems just, proper and appropriate. He is represented by Ari R. Karpf of Karpf, Karpf & Cerutti PC in Bensalem.
