PHILADELPHIA — An inmate has filed a class-action lawsuit against Montgomery County and Montgomery County Correctional Facility, citing alleged unlawful dissemination of information.
Antoine Ellis filed a complaint on behalf of all others similarly situated on May 4 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they allegedly failed to comply with the Pennsylvania Criminal History Records Information Act.
According to the complaint, the plaintiff alleges that he was aggrieved because his criminal record information is readily accessible to the public. The plaintiff holds Montgomery County and Montgomery County Correctional Facility responsible because the defendants allegedly willfully disseminated his criminal history record information on the prison's inmate look-up tool.
The plaintiff requests a trial by jury and seeks judgment against defendants for exemplary and punitive damages of not less than $1,000 but not more than $10,000 for each willful violation of the act, attorneys' fees and costs.
