HARRISBURG — A man is suing David B. Doyle, a New Jersey resident, citing negligence and alleging that insufficient measures were taken to prevent injuries.

Vicente M. Diaz filed a complaint on May 4 in the U.S. District Court for the Middle District of Pennsylvania against Doyle, alleging that the New Jersey resident failed to properly operate his vehicle.

According to the complaint, the plaintiff alleges that on October 4, 2015, while he was parked on the shoulder of the southbound lane of State Routes 6 and 209 in Westfall Township, he was struck defendant’s moving vehicle, causing him injuries that required medical care and treatment, physical therapy, x-rays, diagnostic testing and use of medications. The plaintiff holds Doyle responsible because the defendant allegedly failed to have his vehicle under such control as to be able to stop with the assured clear distance ahead, failed to maintain proper lookout and failed to operate his vehicle in the proper lane of traffic.

The plaintiff requests a trial by jury and seeks judgment against the defendant in a sum in excess of $150,000, plus interest and costs. He is represented by Edwin A. Abrahamsen of Abrahamsen, Conaboy & Abrahamsen PC in Scranton.
