PHILADELPHIA — A business invitee is suing Target Corporation, Besam US Inc., Assa Abloy Entrance Systems Inc. and Besam Automated Entrance Systems Inc., citing alleged failure to warn, negligence, and insufficient measures taken to prevent injuries.
Heather Hartley of Norristown filed a complaint on May 5, in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they allegedly failed to properly maintain a door system to ensure safety of their business invitees.
According to the complaint, the plaintiff alleges that on May 27, 2014, while she was attempting to enter the North Wales Target store, the automatic door suddenly, violently and without warning closed, striking her and causing her to suffer cervical disc herniation and a left shoulder rotator cuff tear. The plaintiff holds the defendants responsible because the defendants allegedly failed to properly install the door system, failed to make reasonable inspection of the door and entrance way, and failed to warn of the malfunctioning of the door system.
The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $75,000 but not exceeding $150,000. She is represented by John Neumann Hickey of Law Office of John Neumann Hickey in Media.
