Worker says oilfield service company didn't pay overtime

PITTSBURGH — A man has filed a class-action lawsuit against Solo Construction LLC, an oilfield service company, claiming he was not paid proper overtime wages.

Paul Flanagin Jr. filed a complaint on May 4 in the U.S. District Court for the Western District of Pennsylvania against Solo Construction LLC, alleging that the oilfield service company allegedly violated the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff alleges that he was typically scheduled for 12-hour shifts, seven days a week, but was not paid an overtime premium for all hours worked in excess of 40 per week. The plaintiff holds Solo Construction LLC responsible because the defendant allegedly intentionally misclassified him as an exempt employee and refused to pay the legally required overtime rate.

The plaintiff requests a trial by jury and seeks compensation for all unpaid overtime wages, plus liquidated damages, attorneys' fees, costs, pre- and post-judgment interest and for all such other and further relief as may be necessary and appropriate.
