Florida state resident accuses former employers of breach of contract
PHILADELPHIA — A foreman is suing Sa-Fe Windows, Inc. and Ferid Brkic, former employers, citing alleged breach of contract, unpaid wages, and violation of workers compensation acts.
David Kirkpatrick filed a complaint on May 9, in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they allegedly violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during his employment in May, June, July, August and September 2013, he has worked for over 40 hours per week but was not paid for all those overtime hours. The plaintiff holds Sa-Fe Windows, Inc. and Ferid Brkic responsible because the defendants allegedly intentionally failed to pay him for hours he actually worked at the minimum wage, failed to pay him a a rate of one and one-half of his hourly rate for each hour worked in excess of 40 hours per workweek and failed to reimburse purchased materials as requested.
The plaintiff requests a trial by jury and seeks compensation for damages and an equal amount of liquidated damages, an order enjoining defendant from further violation of FLSA, reasonable attorney's fees, costs and expenses and such additional relief as justice may require.
