Bridge mechanic says railroad responsible for injuries

PHILADELPHIA — A bridge mechanic is suing Norfolk Southern Railway Company, his former employer, claiming negligence and alleging that insufficient measures were taken to prevent injuries.

Robert Houser filed a complaint on May 10 in the U.S. District Court for the Eastern District of Pennsylvania against Norfolk Southern Railway Company, alleging that the railroad operator failed to provide a safe place to work.

According to the complaint, the plaintiff alleges that during his entire employment of approximately 39 years and while working in various locations throughout the defendant's railroad system, he was injured due to unsafe and inadequate working conditions. He suffered aggravation of existing conditions and cumulative micro trauma disorders/repetitive stress injuries, causing him substantial past and future financial losses, he says. The plaintiff holds Norfolk Southern Railway Company responsible because the defendant allegedly failed to comply with its own safety rules and regulations, failed to comply with the applicable government regulations, failed to periodically test employees for physical effects of repetitive trauma and failed to provide protective equipment designed to protect repetitive trauma injuries.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $150,000. He is represented by Voci R. Bennet of Keller & Goggin PC in Philadelphia.
