Union trustees/agents claims payments not made

PITTSBURGH — Union trustees and agents are suing Central Jersey Trucking & Rigging Inc., an employer, citing alleged default in payment.

Greg Christy and William C. Ligetti, on behalf of the Trustees of the Iron Workers Welfare Plan of Western Pennsylvania Pension Plan and the Iron Workers of Western Pennsylvania Profit Sharing Plan, and as agents for the Ironworker Employers Association of Western Pennsylvania Inc., filed a complaint on May 17 in the U.S. District Court for the Western District of Pennsylvania against Central Jersey Trucking & Rigging, Inc. alleging that the employer violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the trustees/agents, acting on behalf of the union plans, have not received contributions and wage deductions for December 2015, resulting in a principal deficiency of $2,787.17, plus interest through May 13 of $136.69 and liquidated damages of $481.75 for a total deficiency of $3,405.61. The plaintiffs holds the defendant. responsible because the defendant allegedly failed to comply with a collective bargaining agreement and failed to timely pay dues and fringe benefit contributions.

The plaintiffs request a trial by jury and seek preliminary and permanent injunction enjoining the defendant from violating the terms of agreements, directing the defendant to make immediate payments, judgment against the defendant in the sum of $4,255.61, liquidated damages, attorneys' fees of 20 percent of the total amount due and costs of this suit, and for such other and further relief as the court may deem just. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg PC in Pittsburgh.
