PITTSBURGH — A general contractor is suing Pioneer Pipe Inc., an Ohio corporation, citing alleged intentional misrepresentation, promissory estoppel and unjust enrichment.
TEK Construction Services LLC filed a complaint on May 18 in the U.S. District Court for the Western District of Pennsylvania against Pioneer Pipe Inc. alleging that the Ohio corporation failed to comply with the terms of agreement made on June 16, 2014.
According to the complaint, the plaintiff alleges that it has suffered damages in the amount of $99,430 due to not receiving payment for building and maintaining a trench across Epic Access Road. The plaintiff holds Pioneer Pipe Inc. responsible because the defendant allegedly has refused to pay its past-due invoice for the plaintiff's costs to construct and maintain the temporary access road and to backfill the trench.
The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $99,430, together with interest, cost and such other relief as the court deems necessary or appropriate.
