PITTSBURGH — An employee is suing her employer, Steak N' Shake Enterprises Inc., citing alleged negligent hiring, negligent retention and negligent infliction of emotional distress.
Dejah Jordan filed a complaint on May 19 in the U.S. District Court for the Western District of Pennsylvania against Steak N' Shake Enterprises Inc. alleging that the employer failed to provide a safe working environment.
According to the complaint, the plaintiff alleges that since June 2015, co-worker Donna Scales has committed actions including forcefully shoving the plaintiff, grabbing and yanking her hair, pushing another person into her and making threats, leaving the plaintiff unable to properly sleep, suffering from symptoms of PTSD and other symptoms of distress, and generally withdrawn from her enjoyment of life. The plaintiff holds Steak N' Shake Enterprises Inc. responsible because the defendant allegedly did not terminate Scales or otherwise act to protect her, failed to address Scales’ behavior and failed to protect its employees against dangerous co-workers, despite the plaintiff's complaints to the defendant.
The plaintiff requests a trial by jury and seeks judgment in her favor; an award of damages against the defendant, including but not limited to compensatory, punitive, and economic damages; costs of suit; and attorney’s fees, in addition to any other relief that the court finds proper under the circumstances of this case.
