Florida woman seeks disability benefits

PITTSBURGH — An former Exam Works employee is suing Life Insurance Company of North America, claiming she has been improperly denied disability benefits.

Marie Henry of Sorrento, Florida, filed a complaint on May 16 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Company of North America, alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been unable to work since April 2, 2015, due to multiple medical conditions. Since then, she says she has not received the monthly benefits to which she alleges she is entitled, including both short-term disability and long-term disability benefits. The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly failed to pay her short-term disability benefits and refused to render a decision for her long-term disability benefits.

The plaintiff requests a trial by jury and seeks a declaration that the defendant is obligated to pay her past-due disability benefits, an award the costs of this action, plus interest, reasonable attorney's fees and such other further and different relief as may be just and proper. She is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
