Woman sues over husband's death in truck-train collision

HARRISBURG — A widow is suing Norfolk Southern Railway Company, Clinton Township, Griffith Company and the estate of Howard E. Martin Jr., deceased, alleging negligence and insufficient measures taken to prevent injuries.

Shauna Ziemer, as executrix of the estate of Darrin E. Ziemer, filed a complaint on May 26 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they failed to perform their responsibilities, which resulted in Darrin E. Zeimer's death.

According to the complaint, the plaintiff alleges that on Aug. 15, 2014, Darrin E. Ziemer was a passenger in a Griffith Company rented truck driven by Martin when they were hit by a train, which resulted in their deaths. The plaintiff holds the defendants responsible due to allegations including failure to properly light the area and disregarding crossing signs.

The plaintiff requests a trial by jury and seeks judgment against the defendants plus interest and any further relief the court grants. She is represented by Bernard F. Cantorna of Bryant & Cantorna, P.C. in State College.
