Aetna Life Insurance accused of wrongful termination of benefits

PHILADELPHIA – A Downington woman alleges her long-term disability benefits were wrongfully terminated.

Mary Plank filed a complaint on July 22 in the U.S. District Court for the Eastern District of Pennsylvania against Aetna Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2007 she stopped working because she was no longer able to perform her job duties because of her medical injuries and applied for long-term disability benefits. The suit states benefits were approved in November 2007 but the defendant later terminated them in 2012.

The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly terminated plaintiff's disability benefits claiming she was no longer disabled according to the terms of the plan despite evidence from her physicians.

The plaintiff seeks judgment against the defendant in an amount equal to the long-term disability benefits denied to her plus interest, court costs and any further relief as the court grants. She is represented by John J. Stanzione of Lamb McErlane PC in West Chester.
