Suit filed against Philadelphia, USPS after man claims sidewalk caused him to fall

PHILADELPHIA – A man alleges a poorly maintained sidewalk caused him to trip and suffer injuries.

Phillip Davis filed a complaint on July 7 in the U.S. District Court for the Eastern District of Pennsylvania against United States of America in care of the United States Postal Service, and the city of Philadelphia alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 1, 2015, he sustained physical injuries when he tripped and fell due to a hole found on the sidewalk on the defendants' premises and was injured. The plaintiff holds United States of America and the city of Philadelphia responsible because the defendants allegedly failed to inspect their premises for any dangerous condition that may cause accident to pedestrians or provide adequate warnings regarding the condition of the sidewalk.

The plaintiff seeks judgment against the defendant in an amount of more than $75,000 plus court costs and any further relief the court grants. He is represented by Marc I. Simon of Simon & Simon PC in Philadelphia.
