PHILADELPHIA – A Cheswick man alleges exposure to an herbicide caused injuries.

Gary Mancuso filed a complaint on July 29 in the U.S. District Court for the Eastern District of Pennsylvania against Monsanto Co. alleging negligence, strict products liability and other counts.

According to the complaint, the plaintiff alleges he began using the defendant's Roundup in 1981 and as a result, he developed non-Hodgkin's lymphoma in 2008. The plaintiff holds Monsanto Co. responsible because the defendant allegedly falsely advertised Roundup as safe and marketed and sold Roundup without providing adequate warning to consumers about the potential negative effects it could cause.

The plaintiff requests a trial by jury and seeks compensatory damages, economic damages in the form of medical expenses, out-of-pocket expenses, punitive and exemplary damages, interest, all legal fees and any other relief as the court deems just. He is represented by Brian J. McCormick Jr., Robert Ross, Joel J. Feller, Matthew A. Casey and Mark A. Hoffman of Ross Feller Casey LLP in Philadelphia.
