PHILADELPHIA – Several union funds have filed a suit against an employer and its president alleging that contributions were not paid per a bargaining agreement between the parties.
Steamfitters Union, Local 420 Welfare Fund; Steamfitters Union, Local 420 Pension Fund; Steamfitters Union, Local 420 Supplemental Retirement Plan, et al. filed a complaint on July 29 in the U.S. District Court for the Eastern District of Pennsylvania against Multi-Temp Mechanical Inc. and Laura Cuneo alleging violation of the Employee Retirement Income Security Act and the Labor Management Relations Act.
According to the complaint, the plaintiffs allege that they sustained damages from unpaid contributions. The plaintiffs hold Multi-Temp Mechanical Inc. and Cuneo responsible because the defendants allegedly failed to pay their monthly contributions on behalf of their employees from January through March.
The plaintiffs seek judgment against the defendants for the amounts due including interest, liquidated damages, court costs and any further relief the court grants. They are represented by Jeremy E. Meyer and William T. Josem of Cleary, Josem & Trigiani LLP in Philadelphia.
