PITTSBURGH — An employee is suing American United Life Insurance Company, alleging that the insurer violated the Employee Retirement Income Security Act.
Rhonda Carter filed a complaint on Aug. 2 in the U.S. District Court for the Western District of Pennsylvania against American United Life Insurance Company, alleging that the insurance firm improperly failed to provide timely payments of short-term disability benefits.
According to the complaint, the plaintiff alleges that she stopped working as a document processing tagger on Sept. 15, 2014, due to joint pain, migraines and three benign brain tumors and filed for a claim for disability benefits but was denied. The plaintiff holds the insurer responsible because the defendant allegedly denied the plaintiff's disability benefits despite her disability under the terms of the plan and despite having sufficient medical evidence to support her claim.
The plaintiff seeks all relief to which she is entitled under the Employee Retirement Income Security Act, interest, court costs and any further relief the court grants. She is represented by Jessica L. Rafferty of QuatriniRafferty, P.C. in Greensburg.
