PHILADELPHIA — Trustees for labor union funds are suing KTN Interior Products Co. and company owner Laura Nestor citing alleged breach of contract.

Trustees of the National Elevator Industry Pension, Health Benefit, Educational, Elevator Industry Work Preservation Funds, Elevator Constructors Annuity and 401(k) Retirement Plan filed a complaint on Aug. 1 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to pay contributions to the labor funds per a contract.

According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs hold the defendants responsible for allegedly failing to pay monthly contributions on behalf of their employees under the terms of a bargaining agreement.

The plaintiffs seek $84,430.16 in contributions and interest due for the payroll audit of Jan. 1, 2013 through July 8, 2014, plus additional accrued interest and audit fees, liquidated damages in the amount of $16,106.80, court costs, all contributions and liquidated damages due and owing, and any further relief the court grants. They are represented by Robert P. Curley and David D. Capuano of O'Donoghue & O'Donoghue LLP in Philadelphia.
