PITTSBURGH — Two Delaware corporations are suing Power & Industrial Services Corporation, a Pennsylvania corporation, citing alleged patent infringement and unfair competition.
Boiler Tube Company of America and Thermal Engineering International (USA) Inc. filed a complaint on Aug. 11 in U.S. District Court for the Western District of Pennsylvania against Power & Industrial Services Corporation alleging that the Pennsylvania corporation manufactured catalyst door systems which infringe on the plaintiffs' patent.
According to the complaint, the plaintiffs allege that they suffered damages to their business from the patent infringement. The plaintiffs hold the defendant responsible because it allegedly had knowledge of the patent but continued to manufacture and distribute products and services including catalyst doors that infringed on the patent.
The plaintiffs request a trial by jury and seek a permanent injunction against the defendant, an award of damages to the plaintiff including lost profits, increased damages and punitive damages, interest, court costs and any further relief the court grants. They are represented by Jeffrey J. Bresch of Jones Day in Pittsburgh.
