Driver claims unsecured pallet caused injuries

HARRISBURG — A motorist is suing Granite Construction Northeast Inc. and Tappan Zee Constructors, LLC, alleging negligence and insufficient measures taken to prevent injuries.

Walter Porreca filed a complaint on Aug. 23 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they failed to secure the cargo on a truck.

According to the complaint, the plaintiff alleges that on Nov. 14, 2014, a steel pallet fell from the defendants' truck and his vehicle hit it, causing injuries that and pain. The plaintiff holds the defendants responsible because they allegedly failed to make sure that the pallet of steel loaded on the truck was properly secured.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages, monetary relief plus interest and court costs. He is represented by Joseph R. Rydzewski and Christopher J. Finney of Spall, Rydzewski, Anderson, Lalley & Tunis, P.C. in Hawley.
