Granada Apartments partnership accused of defaulting on mortgage

Late 05

PITTSBURGH — A financial institution is suing an apartment partnership based in New York, citing alleged breach of contract.

U.S. Bank National Association, as trustee for the registered Holder of Citigroup Commercial Mortgage Trust 2007-C6, Commercial Mortgage Pass-Through Certificates, Series 2007-c6, filed a complaint on Sept. 16 in the U.S. District Court for the Western District of Pennsylvania against Granada Apartments L.P., alleging that the New York partnership defaulted its obligation on a mortgage.

According to the complaint, the plaintiff alleges that it suffered damages from the unpaid loan owed to it. The plaintiff holds the defendant responsible because the partnership allegedly failed to settle the total loan amount to the plaintiff.

The plaintiff seeks judgment against the defendant in the amount of $18,234,975.14, plus additional accrued and accruing interest, court costs and any further relief the court grants. It is represented by Mark G. Claypool of Knox McLaughlin Gornall & Sennett, P.C. in Erie and Raymond A. Quaglia and Suzanne Lufadeju of Ballard Spahr LLP in Philadelphia.
