International Painters and Allied Trades plans accused of breaching contract

PHILADELPHIA — An employee is suing International Painters and Allied Trades Industry Pension Plan and Board of Trustees of the International Painters and Allied Trades Industry Pension Plan, alleging breach of contract.

Norman Hansen filed a complaint on Sept. 20 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they improperly denied his claim for disability benefits.

According to the complaint, the plaintiff alleges that in February 2015, he applied for disability benefits but was denied. The plaintiff holds the defendants responsible because they allegedly upheld their decision to deny him disability benefits despite him being disabled according to the terms of the plan and despite several appeals.

The plaintiff seeks a declaration of eligibility for disability benefits, damages, interest, court costs and any further relief the court grants. He is represented by Kenneth D. Berman and William J. Fox of Law Office of Kenneth D. Berman in Philadelphia.
