HCR Manorcare accused of not implementing proper care plan

PITTSBURGH -- A representative of a deceased man's estate has filed a wrongful death claim alleging negligence in nursing home care.

Lynn Kapusinski, executrix for the estate of Robert R. Cassella, is suing HCR Manorcare, Inc.; Manor Care of Monroeville PA, LLC, d/b/a Manorcare Health Services - Monroeville; HCR Manorcare, LLC; Manorcare Health Services, Inc., a/k/a Manorcare Health Services, LLC; Manor Care, Inc.; HCR IV Healthcare, LLC; HCR III Healthcare, LLC; HCR II Healthcare, LLC; HCR Healthcare, LLC; HCRMC Operations, LLC; HCR Manorcare Operations II, LLC; Heartland Employment Services, LLC; HCR Manorcare Heartland, LLC; and HCR Manor Care Services, LLC.

Kapusinski alleges insufficient measures were taken to prevent injuries in the care of Cassella. The plaintiff filed her complaint on Sept. 15 in the Court of Common Pleas of Allegheny County against the defendants.

According to the complaint, the plaintiff alleges Cassella fell and was deprived of proper medical care, resulting in the deterioration of his health and contributing to and/or causing his death. The plaintiff holds the defendants responsible because they allegedly failed to implement a care plan for Cassella to address his risk of falling.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $50,000 plus punitive damages and court costs. She is represented by Michael T. Collis of Wilkes & McHugh, P.A. in Pittsburgh.
