Secretary of labor says administrator stiffed employees on retirement plan

PHILADELPHIA — The U.S. secretary of labor is suing Steven Keares Inc., Harry S. Keares and the Steven Keares Inc. 401(k) Retirement Plan, citing alleged breach of contract and breach of duty.

Labor Secretary Thomas E. Perez filed a complaint on Sept. 22 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to remit employee contributions to the retirement plan.

According to the complaint, the plaintiff alleges that, between 2011 and 2014, there were damages suffered on behalf of employees. The plaintiff holds the defendants responsible for allegedly deducting sums from their employees' wages but failing to remit them to the plan.

The plaintiff seeks to restore all loses to the plan plus interest and other remedies. The plaintiff is represented by Oscar L. Hampton III of Office of the Solicitor in Philadelphia.
