Nationwide Mutual Fire Insurance Company seeks decree to avoid indemnification

PHILADELPHIA — An insurance firm is suing William Lolio Sr. and Gina Lolio, citing alleged breach of contract.

Nationwide Mutual Fire Insurance Company filed a complaint on Oct. 24 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, seeking to avoid indemnifying the plaintiffs for a claim.

According to the complaint, the plaintiff alleges that it has no duty to indemnify the defendants according to a policy. The plaintiff claims the defendants improperly want insurance indemnification in a lawsuit filed against them despite the plaintiff's assertion that the injury was due to intoxication from alcoholic beverages.

The plaintiff seeks judgment against the defendants and a decree that the plaintiff has no duty to defend the defendants. It is represented by Joseph B. Mayers and John A. Anastasia of Mayers, Mennies & Sherr, LLP in Plymouth Meeting.
