Employee claims Menasha Corporation failed to provide documents

PITTSBURGH — An employee is suing Menasha Corporation, alleging violation of the Employee Retirement Income Security Act.

Jessie Jones filed a complaint on Oct. 26 in the U.S. District Court for the Western District of Pennsylvania against Menasha Corporation, alleging that the company has refused to provide him with a copy of a collective bargaining agreement and plan documents regarding sickness and accident benefits.

According to the complaint, the plaintiff alleges that he has suffered damages in the course of a dispute involving a workplace injury and a workers' compensation claim. The plaintiff holds Menasha Corporation responsible because the defendant allegedly failed to provide requested documents to him.

The plaintiff seeks penalty in the sum of $100 a day for each and every day he did not receive the plan documents, court costs and any further relief the court grants. He is represented by Neil J. Marcus of Neil J. Marcus, Esquire in Monongahela.
